Our company guarantees its work and covers any defects in workmanship under the normal process of the services.
KMJ Testing is not responsible for any work not outlined and agreed upon in the contract between KMJ Testing and the client.
KMJ Testing is exempt from all claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever which results from or arises from any act or omission by KMJ Testing and its affiliates and employees.
We will not disclose, divulge, reveal, report or use, for any purpose, any Confidential Information which KMJ Testing has obtained, except as authorized by the client or as required by law.
Scope of work
In providing asphalt core testing services, it is expressly agreed that KMJ Testing is an independent contractor and not as an employee.
KMJ Testing and the client acknowledge that the agreement between the parties does not create a partnership or joint venture between them and is exclusively a contract for service.
Except as otherwise stated, KMJ Testing will have full control over working time, methods, and decision making in relation to the provision of services. KMJ Testing will work autonomously and not at the direction of the client. However, KMJ Testing will be responsive to the reasonable needs and concerns of the client.
KMJ Testing will provide at their own expense, any and all tools, machinery, equipment, raw materials, supplies, workwear and any other items or parts necessary to deliver the services as agree with the client.
KMJ Testing and the client, enter a non-exclusive agreement that either Party will be free, during and after the contract term, to engage or contract with third parties for the provision of similar services.
